TABBY TERMS AND CONDITIONS – DUE DATE EXTENSION (TABBY SNOOZE)

These Terms and Conditions ("Terms") govern the Extend Due Date Option offered by Tabby Saudi for Communication and IT LLC, registered in Riyadh, KSA (“Tabby”) (and Tabby is also referred to throughout Terms as "we", "us" or "our"), to eligible customers who shop at certain Merchants. By utilizing the Extend Due Date Option, you agree to abide by these Terms. Please read these Terms carefully before using this option. If you do not agree to these Terms, you should refrain from using the Extend Due Date Option.

1. Extending Your Due Date Service

1.1 An option to extend the Due Date of any Installment (“Extend Due Date Option”) may be offered at Tabby's sole discretion when you shop at certain Merchants.

1.2 If you think you will need more time to make funds available on your payment method before your Due Date, you may apply for the Extend Due Date Option.

1.3 You may choose the Extend Due Date Option only once per order.

1.4 If you choose to avail the Extend Due Date Option, a new commercial arrangement will be entered into specifically for this service.

1.5 The commercial arrangement and the duration of the extension period will be disclosed at the time of you availing the service and will vary based on Tabby's sole discretion.

1.6 Choosing the Extend Due Date Option does not affect or limit your obligations, including your existing obligation to pay Installments, under these Terms.

2. Eligibility

2.1 To be eligible for the Extend Due Date Option, customers must meet Tabby's eligibility criteria, which may include factors such as payment history, account status, and other relevant considerations determined by Tabby at its sole discretion.

3. Availability and Activation

3.1 The Extend Due Date Option is available at Tabby's sole discretion and may vary based on customer eligibility and the participating Merchants.

3.2 You may request to Extend Due Date Option, of any Instalment due under the repayment of their BNPL by contacting Tabby's customer support or through the Tabby App or Website.

4. Discretion of Tabby:

4.1 Tabby reserves the right to approve or deny any request to extend the Due Date at its sole discretion.

4.2 Tabby may choose to grant or deny the Extend Due Date Option for any reason, including but not limited to the customer's payment history, account status, and any other relevant factors determined by Tabby.

5. Fees:

5.1 Tabby may charge a service fee for the Extend Due Date Option based on the size of the Instalment and the length of time which you would like to avail of the Extend Due Date Option, which will be communicated to you at the time of your request.

6. Communication:

6.1 By using the Extend Due Date Option, you agree to receive communications from Tabby regarding the status of your request and any associated fees.

7. Impact on Repayment Schedule:

7.1 Extending your Due Date may impact the repayment schedule of the BNPL agreement. You acknolwedge it is your responsibility to review and understand the implications on your repayment plan as presented to you by Tabby.

8. Right to Cancel:

8.1 Tabby reserves the right to cancel or modify the Extend Due Date Option at any time without prior notice.

9. Applicable Law:

9.1These Terms and the Extend Due Date Option are governed by the laws of the Kingdom of Saudi Arabia. You irrevocably agree that the competent courts of Riyadh, Kingdom of Saudi Arabia shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

By using the Extend Due Date Option, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Tabby reserves the right to update these Terms at its discretion, When we are due to update the App and/or our Website to incorporate any changes to the Terms, you will be notified via your registered email account with us, informing you of the updates / changes at least 30 business days in advance of such change being enforced (provided such change is not otherwise required by applicable law). You will have the opportunity to object to any change to the Terms within 10 days from the date of receiving such notification.

By using the Extend Due Date Option, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
